These Terms and Conditions cover how Equitogs will conduct ourselves on our website what we expect from you when you use the Equitogs website.

Acceptance

When you use and make a purchase from the Equitogs website, you are agreeing to be bound by our terms and conditions (your statutory rights are not affected). We recommend that you read them carefully. We may at anytime revise these terms and conditions without notice, and it is your responsibility to regularly review them.

These conditions are governed by and drawn up in accordance with the laws of England and Wales. You agree, as do Equitogs, to submit to the non-exclusive jurisdiction of the English courts.

In addition, when you use any current or future Equitogs service, you will also be subject to the guidelines and conditions applicable to that service.

We will do our very best to ensure that the website is constantly available. However, this cannot be guaranteed. Access to the website may be occasionally suspended or restricted to allow for maintenance, or the introduction of new facilities or services.

Equitogs reserves the right at any time to change or discontinue without notice, any aspect or feature of this website. No information on the website shall be interpreted as advice and information is offered for information purposes only.

Equitogs reserves the right to edit or remove content, refuse access to this website or cancel an order at our discretion.

Licence for Access to the Equitogs Website access and Copyright rights

Subject to the Terms of this agreement, you are authorised to view the Equitogs website for your personal use only. You are not granted a licence to download, other than page caching, or to modify the Equitogs website in part or as a whole without the express written permission of Equitogs.

All the images & information on this website are the property of Equitogs and its suppliers. Unauthorized reproduction of the contents and design of the Equitogs website in any way is forbidden and is protected by United Kingdom and international copyright and database right laws.

Equitogs does give permission for, and recommends, these terms and conditions are printed and retained by its customers for their reference but no permission is given for these terms and conditions to be used in any other capacity without prior permission.

Equitogs may provide external links to other websites, but these links are beyond the control of Equitogs and Equitogs has no control over their content. You visit and use these external sites at your own risk and must refer to their terms and conditions of use. By using the Equitogs site you are accepting these Terms and Conditions and accept that Equitogs has no control over the content found on any external sites.

Your Conduct

By accepting these Terms and Conditions you confirm that you have permission or the rights to any material you post on the Equitogs website, or any material you grant Equitogs the use of. You agree to indemnify Equitogs and its affiliates for all claims brought by a third party against Equitogs or its affiliates as a result of the material you provide.

Sale of Products

This section deals with conditions relating to the sale of products by Equitogs to you.

Our Contract

Your order represents an offer to Equitogs to purchase a product. Equitog’s contract with you is complete when Equitogs send e-mail confirmation to you, confirming Equitogs have received payment and have dispatched that product to you.

When you place and order on the Equitogs website and your payment has been processed you will receive an order confirmation from both Equitogs.co.uk and an invoice receipt of purchase from Protx. On your order confirmation email from Equitogs.co.uk you will be assigned a unique order number.

Please use this order number if you contact us about your order.

Accuracy

Equitogs strives to ensure that the information included on the Equitogs website is current and accurate. Occasionally errors may occur and it is possible that an item may be miss priced. During the ordering process you will receive a confirmation email (see our Help Page) verifying the price, if you have any queries please contact us on 01403 786 021. If we have a query about a price on an item on your order we will contact you prior to despatching the goods.

Delivery charges

All delivery dates are subject to availability. If a product is unavailable Equitogs will contact you.

Delivery charges vary depending on the type of products ordered and the service you select and can only be refunded in accordance with the terms below and with your legal rights under the Distance Selling Regulations and other legislation.

Returns

The Equitogs returns policy does not affect your Statutory Rights.

To make a return please download and print out our Return / Exchange Form.

In accordance with Distance Selling Regulations goods supplied from the Equitogs website may be returned. Returned items must be unsoiled and in the same condition as dispatched (original packaging and labels in tact). Customers will be entitled to a full refund, less the delivery charge, if the goods are returned within 7 days of the customer receiving the goods. Please note that this also applies to gifts you have purchased and had delivered to a third party.

We can only accept the return of opened items if they are faulty or damaged, or the packaging can be resealed without damaging that packaging. Please consider this when opening product packaging.

Goods being returned to Equitogs are the responsibility of the sender. We recommend that you obtain a certificate of dispatch.

In compliance with Health and Safety regulations goods being returned will not be accepted unless they are clean and dry.

The following items can not be returned or exchanged unless they are faulty or damaged: CD’s, DVD’s, Computer Software, underwear, special order or personalised items.

Sale Items are non-returnable.

Exchanges

An exchange is defined as a product that is ordered and on delivery the customer finds they need a different size or colour of the same product. The customer can then return the product to Equitogs and Equitogs will exchange the product for the correct item subject to availability. Equitogs will not exchange one product for a different product eg: a coat can not be exchanged for a hat.

Delivery charges for the return of goods to Equitogs are the responsibility of the customer. Equitogs will pay for the exchanged goods to be sent to the customer.

The customer will be responsible for any delivery costs, either to or from Equitogs, on any further exchanges of the same product.

Damaged Goods

Goods damaged in transit or due to faulty manufacture should be returned for our inspection. Replacement goods cannot be sent until Equitogs have received the returned goods. Equitogs will credit you with the cost of returning the goods to us. Equitogs will not charge you for the delivery of any replacement goods.

Customs

When ordering goods from Equitogs that are to be delivered outside the UK, the customer is responsible for any import duties and taxes, which may be incurred when the goods arrive in their country of destination.

Equitogs would like customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

Health & Safety

When you purchase a product from Equitogs you accept that you are taking full responsibility for the fitting and safe use of that product.
